Terms and Conditions

1. Definitions

  • “Little Wickets” means Little Wickets (East Midlands) Ltd Franchisee (or Little Wickets Ltd where the territory is operated directly ), as named on the Booking Form, the company or person with whom you have entered into this contract in respect of the provision of classes and Little Wickets Ltd in respect of the provision of the Little Wickets Kit
  • “Booking Form” means the form relating to the booking or re-booking of the Participant for a Term as set out at the booking stage of the website
  • “Parent” means a parent or legal guardian of the Participant who will be responsible for the payment of the Fees and who is the contracting party to this contract and who shall (if the Carer is not the Parent) be responsible for compliance with these Terms & Conditions by the Carer
  • “Carer” means the person who attends the class with the Participant and is responsible for their welfare
  • “Session” means a Little Wickets session described on the Booking Form
  • “Camp”means a Little Wickets single and multi-day holiday daytime activity as described on Booking.
  • “Coach” means the individual engaged by Little Wickets Ltd or Little Wickets (East Midlands) Ltd to lead the sessions. Whilst every effort will be taken to maintain the consistency of the Coaches during the Term Little Wickets retains the right to retain the right to change the coaching staff where necessary. A coach may also engage the services of assistant coach(es) at the sessions. Beyond the individual responsibility of Parents/Carer any child welfare and/or health & safety Issues are the responsibility of the Lead Coach.
  • “Fees” means the value chargeable to attend Classes for the Term, as specified on the Booking Form
  • “Parent” means a parent or legal guardian of the Participant who will be responsible for the payment of the Fees and who is the contracting party to this contract and who shall (if the Carer is not the Parent) be responsible for compliance with these Terms & Conditions by the Carer
  • “Participant” means the child who is attending or who is booked on to a Little Wickets session whose details are specified by the Parent or Carer on the Booking Form
  • “Premises” means the premises where the Classes take place
  • “Term” means the agreed dates on the Booking Form and as described under �Where & When� on the Website
  • “Terms & Conditions” means the terms and conditions set out in this document and any special terms and conditions agreed in writing by Little Wickets and the Parent
  • “Website” means the website at www.littlewickets.com and www.littlewickets.co.uk

2. Bookings

  • Little Wickets sessions and camps may be booked online, by telephone or via email and are subject to spaces being available. All bookings must be paid in full and validated by Little Wickets before confirmation of a place is sent.
  • Confirmation of a participant\’s place will be sent via email, unless an alternative method has been specifically agreed by Little Wickets.
  • Little Wickets from time to time offers promotions and discounts. Redemption of any such promotional offers/discounts must be advised at the time of booking and can only be used in accordance with the terms and conditions of that promotion and in line with all other Little Wickets Policies, Terms & Conditions.
  • Bookings are subject to Little Wickets Policies, Terms and Conditions, which are available on request and/or on the website www.littlewickets.com
  • All bookings & payments must be made and confirmed at least 24 hours in advance directly with Little Wickets. Coaches cannot take payments at the sessions and ad hoc \’walk-up\’ bookings are strictly prohibited to ensure appropriate coaching ratios are maintained.
  • All bookings once confirmed by Little Wickets are final and non-refundable.

3. Fees & Payment

  • The Parent shall pay the Fees for the Term to Little Wickets prior to the Participant commencing a Term.
  • Little Wickets reserves the right to change “Late Payment” fees for payment after the communicated booking deadline.
  • Little Wickets reserves the right to charge a “Booking Fee” &/or �Payment Fee� for different types of payment such as Credit Cards or Pay Pal. Any such fees maybe be based on a per participant basis or a per payment basis and will be advised in advance of a booking being made.
  • The Fees are not refundable in any circumstances whatsoever other than with the written consent of Little Wickets.
  • The Little Wickets Newcomer\’s Guarantee, states that if after two weeks any new participant to the Little Wickets programme cancels for whatever reason, they will be repaid any unused pre-paid sessions on the basis that the used sessions were at the rate of �7.00 per session. All claims on the Newcomer�s Guarantee must be notified to Little Wickets as soon as possible and no later than midnight the day before their third next session.

4. Acceptance

  • All agreements and issues relating to the teaching of the sessions by Little Wickets to the Participant and the on-going communication with Coaches, back office staff and Little Wickets head office are subject to the Terms & Conditions to the exclusion of all others.
  • No variation or addition to the Terms & Conditions shall be binding unless agreed in writing by Little Wickets and the Parent.
  • These Terms & Conditions shall be deemed to be accepted by the Parent and the Carer once the box is ticked on the Booking Form and confirmation of payment of Fees has been received by Little Wickets.
  • Little Wickets may cancel this contract at any time before the Participant commences a Term, for any reason whatsoever. Little Wickets shall not be responsible for any loss or damage whatsoever arising from such cancellation but will refund Fees paid for the remaining sessions in the Term.

5.Confidentiality

  • By agreeing to these Terms & Conditions the Parent and/or Carer agrees not to share any aspects of Little Wickets programme with a third party who may be involved in a business that operates in the same market as Little Wickets. The Parent and/or Carer will not be involved directly or indirectly with such a company.
  • The Parent and/or Carer will not take, replicate or use any Little Wickets material directly or indirectly for his/her own use or for use by any third party
  • The Parent and/or Carer agree not to directly or indirectly be involved or interested in the any business which competes with Little Wickets while the participant is a pupil of Little Wickets and for a period on one year thereafter.
  • Little Wickets will hold all personal data in accordance with its Privacy & Data Policy, available on our website www.littlewickets.com

6. Parent/Carer Obligation for Regular 1st & 2nd Innings Sessions

  • The Parent warrants that the information provided on the Booking Form is accurate and up to date in all respects at the point of booking. Any changes will be sent by the Parent and/or Carer to Little Wickets immediately.
  • It is the Parent and/or Carer\’s responsibility to inform Little Wickets of any special medical conditions at the point of booking. This includes behavioural disorders.
  • The Participant and/or Parent and/or Carer must not attend any session whilst suffering from any serious illness or contagious disease or anything similar thereto.
  • During all regular sessions the Parent and/or Carer agrees and accepts the sole responsibility, general conduct and care for the Participant during the session and whilst on the Premises.
  • Little Wickets does not allow the Parent and/or Carer to leave the Participant for any amount of time before, during or after a Class. Whether in the specific venue or watching the Parent/Carer must remain on the Premises during the session and if not immediately within sit must advise the Coach of their exact location on site.
  • Little Wickets shall have the sole right to exclude the Participant and/or Parent and/or Carer either permanently or for such period as Little Wickets shall (in its entire discretion) determine if deemed necessary for the safety and well-being of other participants or parents or carers.
  • Particular attention is drawn to Little Wickets policies regarding Child Protection, Health & Safety, Personal Property & the use of Film & photography during Holiday Camps as outlines as part of these Terms & Conditions.

7. Parent/Carer Obligations for Participation in Holiday Camps

  • The Parent must complete a Registration Form in advance of the first day of participation at a Little Wickets Holiday Camp.
  • The Parent warrants that the information provided on the Booking Form &/or the Registration Form is accurate and up to date in all respects at the point of booking.
  • Any changes will be sent by the Parent and/or Carer to Little Wickets immediately.
  • Little Wickets will hold all personal data collected on Booking & on Registration Forms in accordance with its Privacy & Data Policy, available on our website www.littlewickets.com
  • It is the Parent and/or Carer\’s responsibility to inform Little Wickets of any special medical conditions at the point of booking and including the information on the Camp registration Form. This includes behavioural disorders.
  • The Participant must not attend any holiday camp whilst suffering from any serious illness or contagious disease or anything similar thereto.
  • Tuck Shop – Little Wickets camps include a Tuck Shop, offering a variety of products at lunch and break times for participants to purchase. Items may include but fresh fruit, non-fizzy drinks, crisps and confectionary. Little Wickets operates a healthy eating policy and our staff will always encourage children to eat their packed lunches before buying anything from the Tuck shop. If Parents/carers do not wish a participant to have anything from the Tuck Shop the information must be provided on the Camp registration form and in the case of food allergies be advised in writing on booking.
  • Little Wickets shall have the sole right to exclude the Participant either permanently or for such period as Little Wickets shall (in its entire discretion) determine if deemed necessary for the safety and well-being of other participants, coaches &/or other parties.
  • In the case of illness, injury or behavioural issues it is the responsibility of the Parent/Carer to arrange for immediate collect the participant from the camp, on notification by Little Wickets.
  • Particular attention is drawn to Little Wickets policies regarding Child Protection, Health & Safety, Personal Property & the use of Film & photography during Holiday Camps as outlines as part of these Terms & Conditions.

8. Child Protection

  • All Little Wickets Lead Coaches hold current child protection and CRB/DBS certification, which is available on request from Little Wickets Head Office.
  • In the event that a child makes a disclosure or a member of staff believes that the child is suffering from abuse we will act in accordance with our child protection policy, a copy is available on request.

9. Health & Safety

  • Risk assessments for each venue are available on request.
  • Little Wickets coaches hold up to date emergency first aid certificate issued by an appropriate body.
  • Little Wickets\’ coaches have the right to cancel any activity at any point if they becomes aware of any matter which may jeopardise the health & safety of one/any participant, parents/carers, the coach or assistants.
  • It is the parent/guardian\’s responsibility to ensure appropriate clothing is worn and/or available for their child for the activity provided and weather conditions. Regular sessions are normally indoors. However, whilst every effort will be made to advise parents/carers in advance there are occasions when the coach my deem the planned activity, the weather and the facilities all appropriate to hold the session outdoors.
  • Holiday Camps may involve a combination of indoor and outdoor activities, depending on the time of year, as described on Booking.

10. Personal Property

  • The Parent/Carer ineminifies Little Wickets against any loss or damage to any personal belongings whilst attending Little Wickets sessions or Holiday Camps.
  • Participants should not bring valuable items to the venue and all items including clothing should be appropriately named.

11. Film/Photography

  • Little Wickets may from time to time take photographs/film at holiday camps and regular sessions, the use of this data is solely for the administrative and marketing use of the Little Wickets Group and any associated organisations.
  • The use of this material may include but is not limited to direct communication with prospective customers, in printed literature, via the internet, on the website, via social media sites, in the press and on TV.
  • Parents/carers that do not wish the participant to be photographed/filmed must make Little Wickets aware of this at the time of booking, on the holiday camp registration form or in writing before the activity starts. Where possible Little Wickets will inform Parents/carers if any film or photography is planned.
  • Little Wickets will hold all personal data relating to photography and film in accordance with its Privacy & Data Policy, available on our website www.littlewickets.com

12. Complaints

  • In the unlikely event that a Parent/Carer or a Participant is dissatisfied with any element of the Little Wickets service, the matter should be raised as soon as possible, either with the Coach, the relevant Little Wickets Office and/or followed up in writing to Little Wickets Head Office.
  • Little Wickets, the coaches and any agent of Little Wickets will deal will the issue in accordance with our policies and procedures.
  • If any issue is not resolved, the matter must be escalated to Little Wickets Managing Director Chloe Williams (chloe@littlewickets.com) within 7 days of the issue arising.
  • All comments and issues are taken very seriously and every effort will be made to resolve the matter as quickly as possible.
  • Refunds will only be issued if Little Wickets is in breach of its policies, terms & conditions.

13. Limitation of liability

  • The Parent and/or Carer agrees that any claim made against Little Wickets will be made in writing within 30 days of the incident taking place and failure to report in writing within this time will negate any such claim.
  • The maximum aggregate liability for Little Wickets to the Participant, Parent and/or Carer will not exceed the Fees.
  • Neither Little Wickets nor any Coach, coach assistant nor any employee, agent or other representative accepts responsibility in respect of loss, damage or expense incurred by a Participant, Parent and/or Carer arising directly or indirectly or in any way connected with the attendance of the Participant, Parent and/or Carer at sessions (or any session) or any other act or omission on the part of Little Wickets, its Coaches, coaches assistants, employees, agents and/or representatives.
  • All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or excluded liability for death or personal injury caused by the negligence of Little Wickets, its Coaches, coaches assistants, employees, agents and/or representatives or affects the statutory rights of the parent or Participant.
  • The Parent and/or Carer agrees that any product purchased from the Little Wickets merchandise store is to be used at their own risk. Little Wickets will not accept responsibility for any personal injury which may occur due to improper use. As a consequence, Little Wickets recommends that all equipment is used under the supervision of a Parent/Carer.

14. General

    • By agreeing to these terms and conditions the Parent consents that the data provided (non-financial) can be shared within the Little Wickets group.
    • The Parent shall indemnify and keep indemnified Little Wickets against all loss (including loss of profit), liability, cost and expenses which Little Wickets may incur directly or indirectly as a consequence of any action or inaction of the Parent, Carer and/or Participant.
    • Any notices to be sent by either party to the other shall be sent by pre-paid recorded delivery or hand delivered to the address of the relevant party and shall be deemed to have been received by the addressee within 48 hours of posting or immediately if hand delivered.
    • The failure by either party to enforce at any time or for any period any one or more of the obligations arising under this contract shall not be a waiver of them or of the right at any time subsequently to enforce any or all of such obligations.
    • These terms and conditions constitute the entire agreement between the parties hereto and supersedes prior agreements and understandings between the parties.
    • This contract shall be governed by the laws of England and the parties submit to the exclusive jurisdiction of the English courts.
